This End User License Agreement ("EULA", "Agreement") is a legal agreement between you ("User", "you", or "your") and SafeOrbit ("we", "our", or "us") governing your use of the SafeOrbit mobile application ("the App"), a family safety and emergency coordination service for iOS devices.
By downloading, installing, accessing, or using SafeOrbit, you agree to be bound by this EULA. If you do not agree to these terms, do not use the App.

The App, including all content, features, functionality, design, code, graphics, text, and other materials, is owned by SafeOrbit and its licensors and is protected by copyright, trademark, and other intellectual property laws. This EULA does not transfer any ownership rights to you.
All trademarks, service marks, and logos displayed in the App are the property of their respective owners. The SafeOrbit name and logo are trademarks of SafeOrbit.

You are solely responsible for all activities that occur under your account, including any misuse of location sharing or SOS features.
We reserve the right to modify, suspend, or discontinue the App or any part of it at any time, with or without notice. We do not guarantee that the App will be available at all times or free from errors, interruptions, or security breaches.
We may update the App to add features, fix bugs, or improve security. You are responsible for installing updates to ensure optimal functionality and security.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
SafeOrbit is not a replacement for emergency services. In case of a real emergency, you should always contact your local emergency services (e.g., 911 in the United States) immediately. The App is designed to complement, not replace, professional emergency response services.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SafeOrbit SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total liability to you for all claims arising from or related to this Agreement or your use of the App shall not exceed the amount you paid for the App (if any) in the twelve (12) months preceding the claim, or $10, whichever is greater.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless SafeOrbit, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
This Agreement is effective until terminated by either party. You may terminate this Agreement at any time by:
We may terminate or suspend your access to the App immediately, without prior notice, if you violate this EULA, engage in fraudulent or illegal activity, or for any other reason at our sole discretion.
Upon termination, your right to use the App will cease immediately, and we may delete your account and data in accordance with our Privacy Policy. Sections of this Agreement that by their nature should survive termination will remain in effect.
This EULA is between you and SafeOrbit, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content. However, Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement and will have the right to enforce it against you.
If the App is downloaded from the Apple App Store, you acknowledge that:
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which SafeOrbit operates, without regard to its conflict of law provisions.
Any disputes arising from or relating to this Agreement or the App shall be resolved through good faith negotiations. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
We reserve the right to modify this EULA at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such modifications constitutes acceptance of the updated terms.
The latest version of this Agreement will always be available in the App Store listing and at dmytrovirych.com/safe-orbit/terms.
If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
This EULA, together with our Privacy Policy (available at dmytrovirych.com/safe-orbit/privacy), constitutes the entire agreement between you and SafeOrbit regarding the use of the App and supersedes all prior agreements and understandings.
